By accessing or using BetterOS (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.
These Terms constitute a legally binding agreement between you and BetterOS ("Company," "we," "us," or "our").
Description of Service
BetterOS is a context-aware life operating system that provides:
- AI-powered coaching and conversation modes
- Task and goal management
- Voice-first interaction features
- Custom AI mode marketplace
- Daily accountability features
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
Eligibility
3.1 Age Requirement
You must be at least 16 years old to use BetterOS. By using the Service, you represent and warrant that you meet this requirement.
3.2 Legal Capacity
You must have the legal capacity to enter into binding contracts. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
Account Registration and Security
4.1 Account Creation
- • You must provide accurate, current, and complete information.
- • You are responsible for maintaining the confidentiality of your credentials.
- • You are solely responsible for all activities under your account.
4.2 Account Termination
We reserve the right to suspend or terminate your account at any time, for any reason, without notice or liability.
Acceptable Use Policy
5.1 Prohibited Activities
You agree NOT to:
- • Use the Service for any illegal purpose or violate any laws.
- • Harass, abuse, or harm others.
- • Transmit malware, viruses, or harmful code.
- • Reverse engineer, decompile, or scrape data from the Service.
- • Use the Service to create competing products.
- • Share your account with others.
5.2 Content Standards
You are solely responsible for all content you submit. You agree not to submit content that is illegal, infringing, defamatory, or contains personal information of others without consent.
5.3 Enforcement
We reserve the right to remove any content and terminate accounts that violate these Terms, without notice or refund.
AI-Generated Content and Disclaimers
6.1 NO PROFESSIONAL ADVICE
THE SERVICE PROVIDES GENERAL INFORMATION ONLY. IT DOES NOT PROVIDE:
- • Medical, mental health, or therapeutic advice
- • Legal or financial advice
- • Professional counseling
DO NOT RELY ON AI-GENERATED CONTENT FOR CRITICAL DECISIONS. ALWAYS CONSULT QUALIFIED PROFESSIONALS.
6.2 AI Limitations
You acknowledge that AI may produce inaccurate, biased, or misleading information. AI responses are not reviewed by humans and cannot replace human judgment.
6.3 No Liability for AI Content
WE ARE NOT RESPONSIBLE for decisions made based on AI content, or any harm/offense resulting from AI recommendations.
Intellectual Property Rights
7.1 Our Rights
All content and functionality of the Service are owned by us or our licensors and are protected by intellectual property laws.
7.2 Your Content
You retain ownership of content you submit, but you grant us a worldwide, royalty-free, perpetual license to use, modify, distribute, and use your content to train and improve our AI models.
7.3 Marketplace Content
If you publish custom modes, you grant other users a license to use them. We may remove modes at any time without notice.
Subscription and Payment Terms
8.1 Subscription Plans
- • Free Tier: Limited features as described in the app.
- • Pro Tier: Full access to premium features for a recurring fee.
8.2 Payment Processing
Payments are handled via third-party providers (RevenueCat, Stripe, Apple, Google). You agree to their terms.
8.3 Billing
Subscriptions automatically renew. You authorize recurring charges. Prices may change with 30 days' notice. No refunds for partial periods.
8.4 Cancellation
You may cancel at any time. Cancellation takes effect at the end of the current billing period. NO REFUNDS PROVIDED FOR UNUSED TIME.
Third-Party Services
The Service integrates with providers like Google (Gemini AI), ElevenLabs, Supabase, and others. We are not responsible for the availability or actions of these third-party services.
Data and Privacy
Your use of the Service is governed by our Privacy Policy. You consent to the processing of your data by third-party AI providers and international data transfers to improve AI models. WE CANNOT GUARANTEE ABSOLUTE DATA SECURITY.
Disclaimers and Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
WE DO NOT GUARANTEE THAT THE SERVICE WILL MEET YOUR EXPECTATIONS, BE UNINTERRUPTED, OR BE FREE FROM ERRORS. USE AT YOUR OWN RISK.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS, OR $100, WHICHEVER IS LESS.
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR PUNITIVE DAMAGES.
Indemnification
You agree to defend and hold harmless BetterOS from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your reliance on AI-generated content.
Service Availability and Modifications
We reserve the right to modify, suspend, or discontinue the Service or change pricing at any time. We are not liable for any service interruptions.
Termination
We may terminate your access immediately for violations of these Terms or non-payment. Upon termination, your right to use the Service ceases immediately and no refunds will be provided.
Dispute Resolution
16.1 Governing Law
These Terms are governed by the laws of your jurisdiction.
16.2 Arbitration
YOU AGREE THAT DISPUTES WILL BE RESOLVED THROUGH BINDING ARBITRATION, NOT IN COURT.
16.3 Class Action Waiver
YOU AGREE TO BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY, NOT AS A CLASS MEMBER.
Force Majeure
We are not liable for delays or failures caused by events beyond our control, including natural disasters, internet failures, or cyberattacks.
Miscellaneous
These Terms and our Privacy Policy constitute the entire agreement. If any provision is unenforceable, the rest remain in effect. You may not assign these Terms without our consent.
Special Provisions
Users in California, the EU, and Australia may have additional statutory rights under local consumer protection laws that cannot be excluded.
